These General Terms and Conditions (GTC) apply exclusively to purchases made through specific online stores operated by Hecht und Barsch GmbH. These terms are valid only for the stores associated with this document and do not extend to any other shops or platforms managed by the company.

1. Scope

These General Terms and Conditions (GTC) apply to all contracts for the purchase of goods, services, or other items (hereinafter referred to as "goods") via the online shop at the above URL in the version valid at the time of the contract conclusion. Deviating terms of the customer shall not become part of the contract unless explicitly agreed upon by the Provider.


2. Conclusion of the Contract

2.1 Offers in the online shop represent a non-binding invitation to place an order.

2.2 Placing an order:
Customers can place orders via the Provider's online order form. The contract is concluded when:

  • The Provider confirms the contract in writing or via text (e.g., email).
  • The Provider delivers the ordered goods.
  • The Provider requests payment (e.g., via invoice or credit card).

2.3 Before finalizing the order, customers can review and correct their entries via standard input methods (keyboard, mouse, etc.).

2.4 The contract text is stored by the Provider and sent to the customer in text form (e.g., email) after the contract is concluded.

2.5 Contract languages available: English, French, Polish, Swedish.


3. Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal for distance contracts. Details are outlined in the withdrawal policy, provided before the conclusion of the contract.


4. Payment and Default

4.1 Prices and payment:

  • Prices at the time of the order include VAT but exclude shipping costs.
  • Payment options are displayed during the checkout process.

4.2 Invoice payment: Immediate payment unless otherwise stated.
4.3 Credit/debit card payment: Due immediately after order confirmation.
4.4 PayPal payment: Processed via PayPal (Europe) S.à r.l. et Cie, S.C.A.


5. Retention of Title

The goods remain the property of the Provider until full payment has been received.


6. Delivery and Self-Supply Reservation

6.1 Delivery:

  • Delivery is made to the address provided within the timeframe stated in the shop.

6.2 Curbside delivery: For shipments via freight, delivery will be made to the nearest public curbside at the address.

6.3 Self-pickup: Not available.

6.4 Non-delivery:
If the Provider cannot deliver due to unforeseen circumstances (e.g., supplier issues), they may withdraw from the contract, refunding any payments made.


7. Warranty

The statutory warranty rights apply.


8. Liability and Indemnification

8.1 Unlimited liability:
The Provider is fully liable for damages caused by:

  • Intent or gross negligence.
  • Injury to life, body, or health.
  • Breach of warranties or legal provisions.

8.2 Limited liability:
For negligent breaches of essential contractual obligations, liability is limited to foreseeable damages typical for the contract.

8.3 Exclusion of liability:
In all other cases, liability is excluded unless mandatory legal regulations apply.

8.4 Indemnification:
Customers indemnify the Provider against third-party claims arising from unlawful or contractual breaches by the customer.


9. Data Protection

The Provider handles personal data confidentially and in accordance with statutory data protection regulations. For details, refer to the privacy policy.


10. Final Provisions

10.1 Governing law: German law applies, excluding the UN Sales Convention.

10.2 Jurisdiction: For merchants or legal entities, the Provider's location is the place of jurisdiction.

10.3 Severability clause: If any provision is invalid, the remaining provisions remain unaffected.


11. Online Dispute Resolution and Consumer Arbitration

The EU provides an online dispute resolution platform:

The Provider is not obligated or willing to participate in dispute resolution before a consumer arbitration board.
